My wife was forced into a C section cause a breach baby when she wanted to give birth naturally. Can we sue the doctor?

My wife recently had a baby and the doctor insisted she have a cesarean section because the baby was breach, even though my wife was adamant about natural childbirth. My wife is very upset about this, she felt she was pressured into signing the consent forms and did not want to have our baby this way. Does this fall within the definition of negligence at birth and can we sue our doctor for this?

Although it is impossible to determine whether the behavior of the doctor was reasonable without knowing the full circumstances, it is likely that your doctor acted in line with medical practice when he suggested a Caesarian section for a breach delivery. However, your wife’s preference certainly should have been taken into account and doctors must obtain informed consent without coercion prior to administering medical procedures. Your best course of action would be to discuss your situation with a  personal injury attorney to evaluate the case; however keep in mind there usually must be actionable damages and if both your wife and the baby are healthy, it is possible the attorney will tell you that you sustained no actionable damages.
